Sleep In Back Pay
Today we have heard that the Court of Appeal has handed down judgement on the case regarding the National Minimum Wage and Sleep In Shifts.
The judgement states very clearly that the National Minimum Wage (NMW) does not apply to sleep-in shifts unless the worker is awake for the purpose of working.
For Andover and District Mencap and our employees, we will be reviewing our situation. We will seek advice from our Legal advisors, review any guidance provided by the HMRC and have discussions with Hampshire County Council who are the main funders of our care support work. We will make a full statement on this matter in due course.
